Menstrual Leaves Should No Longer Be Up for Debate

The Karnataka government’s proposal to allocate 6 days of menstrual leave per year for women in the public and private sector will reopen debate and discussions on its requirement in the workplace. The absence of National Legislation in India that provides for menstrual leaves to working women is a pivotal indicator of the status accorded to women’s issues and needs in parliament. 77 years after independence, we have three other states- Bihar, Kerala, and Orissa, and a handful of private companies such as Swiggy, Zomato, Magzter, etc, which have taken steps to acknowledge and extend support for this universal biological phenomenon.

Public Outrage On Kolkata Doctor’s Death Case

Rape and murder, considered brutal crimes, almost always evoke huge public outrage. Such is the recent case of a man, named Sanjay Roy, who is alleged to have committed rape and murder of a 31-year-old doctor, whose body was found on 9th August 2024, at the seminar room of R G Kar Medical College and Hospital, Kolkata. This horrendous incident has infuriated the Indian Medical Association (IMA) and so many doctors, across the state and other parts of India, leading them to protest regarding speedy imposition of punishment on those responsible for the said crimes.

Steering the ‘Menstrual Leave Policy’ Debate in a Legal Direction

The long-standing debate regarding menstrual leave policy (hereinafter referred to as ‘the policy’) has erupted once again since the Supreme Court dismissed a petition seeking menstrual leave, on 8th July 2024. A three-judge bench consisting of CJI DY Chandrachud and Justices J.B. Pardiwala and Manoj Mishra stated that the court cannot take up policy matters that fall clearly within the executive’s domain and in turn, directed the government to frame a policy for the same. A concern flagged by CJI DY Chandrachud while dismissing the petition revolves around gender representation as it is feared that recruiters will have lesser preferences for women due to the ‘paid leave’ factor.

Medical Termination Of Pregnancy (Amendment) Act, 2021: Progressive But Restrictive

The Medical Termination of Pregnancy (Amendment) Act, 2021 has become operative from the 24th of September 2021. The amendment alters the parent legislation i.e., Medical Termination of Pregnancy Act, 1971 (MTP Act 1971) which provides a legal framework regarding abortions in India. The amendment increases the gestation limit for abortions by amending Section 3 of the act.

Menstrual Hygiene and Mother Nature

One in every three girls around the world do not have access to proper sanitation facilities. The data speaks a lot about the discrimination faced by menstruating people around the world leading to periods illiteracy amongst the mass as well as sanitation industry. In India specifically, 71% of the menstruating girls remain unaware of menstruation until their first cycle and the culture of shame related to menstruation has ensured the lack of awareness on menstrual products. Studies indicate that most girls do not have consistent access to good-quality menstrual hygiene products with 88% of women and girls in India using homemade alternatives, such as old cloth, rags, hay, sand or ash making them susceptible to all kinds of diseases.

Abortion Law in India: Not Quite There Yet

The Medical Termination of Pregnancy (Amendment) Bill, 2020 was approved by the upper house of the parliament and received presidential assent in March, 2021. Some of the amendments brought in by the new Act were hailed by many for further liberalizing access to abortion in India. On the other hand, some leaders of the opposition had voiced concerns, demanding a detailed scrutiny of the Bill by a parliamentary standing committee. The Bill, however, was passed without any further deliberation or amendments.

एक अध्ययन के मुताबिक कूड़ा बीनने वालों में 80 फीसदी संख्या महिलाओं की है और ये सब महिलाएं दलित समुदाय से सम्बन्ध रखती है, जैसे कहा जाता है कि सारे दलित तो सफाई कर्मचारी नहीं है परन्तु सभी सफाई कर्मचारी दलित ही है। भारत में कोई महिला या पुरुष अपने काम की वजह से सफाई कर्मचारी नहीं है बल्कि वह अपने जन्म के कारण सफाई कर्मचारी है, भले ही वह ये काम करना चाहती/चाहता हो या नहीं । यहां यह सब जाति और पितृसत्तात्मक सोच के कारण है।
